By accessing, browsing or using this site you agree to have read and accepted these Terms and Conditions of Website Use and accept to abide by them. The use and access to this Website will be subjected to the Conditions of Use that are in force at the time of entering the site. meso.Institute reserves the right to modify at any time any of the present Conditions of Website Use as well as any other general or particular conditions that may be applicable. meso.Institute will indicate in the Website the changes made to them and users will be requested to give consent. Anyway meso.Institute invites Users to check the present Terms and Conditions of Website Use periodically.

The access to this Website is free except for the cost of connecting to the network provided by your supplier.

2. CONTENTS

Through our Website you will have access to the mesoInstitute online shop. The same way, Users will be able to subscribe to the mesoInstitute electronic newsletter, which will keep you informed about all issues of your interest and about sale promotions.

mesoInstitute reserves the right to modify any time the presentation, configuration and location of the Website and/or the above mentioned “Contents” as well as the corresponding conditions of access and use.

3. USE OF WEBSITE

mesoInstitute Website has a customer’s area (“User’s Area”), to which users can have access by filling the registration form (“Registration Form”). mesoInstitute reserves its right to freely accept or reject a registration application from a user. The data entered by the User in the registration form must be always accurate, updated and true.

The User acknowledges and accepts that having access and using the Website and/or its Contents takes place freely and consciously under the user’s exclusive responsibility. mesoInstitute will not be in any way responsible for the way Users or third parties use the Website or its Contents or for the damage that may derive from it.

4. INDUSTRIAL AND INTELLECTUAL PROPERTY RIGHTS

The User acknowledges and accepts that all rights of intellectual and industrial property regarding the Contents and/or any other elements contained in the Website (including without limits brands, logos, commercial names, texts, pictures, graphics, designs, sounds, database, software, flow charts, audio and video presentations), belong to meso.Institute and/or third parties.

meso.Institute authorizes the users to use, visualize, print, download and store the Contents and/or elements included in the Website for personal, private and non-lucrative purposes, always when source or author is indicated and when, given the case, the copyright or trademark logo of the owners appear. Any other use of any Content or other elements included in the website different from those hereby specifically indicated is subjected to prior authorization by meso.Institute or the third party that is the owner of the copyright.

mesoInstitute does not guarantee the availability or continuity of the Website and will not be held responsible for the contents stored by third parties in any mesoInstitute Website owned by mesoInstitute. Therefore mesoInstitute will not be responsible for any damage that may derive from

These terms will apply to any contract between us for the sale of products to you. 1.2 Identity of the Purchaser

For the purposes of these terms, the term “Purchaser” means the person buying mesoInstitute products on the Website and must have sufficient legal capacity to enter into contracts.

By placing an order, the Purchaser agrees that:

– They are eligible to purchase meso.Institute products on the Website;

1.3 Information on the products

The images of the Products on the Website are for illustrative purposes only. Although mesoInstitute makes every effort to display the colours accurately, the meso.Institute products received may vary slightly from those images.

All mesoInstitute products shown on the Website are subject to availability. mesoInstitute will inform the Purchaser by e-mail as soon as possible if the meso.Institute Product ordered is not available.

mesoInstitute reserves the right to add new products, remove products or chair their appearance or price at any time. In the absence of an error, the Information on the products and prices applicable to the order will be those appearing on the Website at the time the Purchaser confirms their order.

2. THE ORDER

2.1 The various stages of the order are as follows:

2.1.1 Order on the Website

The Purchaser selects the product(s) of his/her choice and adds it/them under the heading “Your Basket”. He/she can check the details of the planned purchase and change them at any time.

The Purchaser must then validate his/her details, billing address, location and form of delivery and the selected payment method. Please take the time to read and check the order at each page of the order process.

As soon as the Purchaser confirms his/her order by clicking on the “Confirm your payment” icon, the Purchaser is considered to have confirmed the contents and conditions of the order, the prices, characteristics, quantities and delivery deadlines for the ordered products. The order cannot be amended after this point.

2.2 Order confirmation

After the order is placed, mesoInstitute sends the Purchaser an e-mail summarizing the terms and conditions of the order. Please note that this does not mean that the order has been accepted. mesoInstitute’s acceptance of the order will take place when the products are dispatched for delivery.

The Purchaser may track the status of the order and download his/her invoice in the “Your Account” section on the Website.

Orders on the Website or by telephone, including their cancellation can only be processed via the Website or the telephone.

2.3 Unavailability of products

In the event of unavailability of a mesoInstitute product after placing the order, the Purchaser shall be informed of the consequences to his/her order at latest by the time of delivery. Only the products, which are dispatched, will be invoiced.

2.4 Cancellation of the order

mesoInstitute reserves the right to cancel any orders at its discretion including without limitation:

– Where the products are unavailable;

-Where mesoInstitute has reason to believe that the Purchaser does not comply with the eligibility criteria set out in these terms;

– Where the information provided by the Purchaser is incomplete or inaccurate;

– Where there is an event of default on payment or partial payment of amounts owed by the Purchaser; and

– Where there are events beyond mesoInstitute’s control as set out in clause 9 (Events outside mesoInstitute’s control).

The Purchaser may cancel his/her order by exercising his/her right of withdrawal under the conditions stipulated in clause 6 (Right of Cancellation).

3. PRICES

The sale prices of meso.Institute products are indicated in Euros (€)  at the rate in effect on the day of the order and excluding delivery charges. A currency converter where you can convert to your currency on the final step of the buying process of our website.

mesoInstitute takes reasonable care to ensure that the prices of meso.Institute products are correct at the time when the relevant information was entered onto the system. However if mesoInstitute discover an error in the price of mesoInstitute products ordered, mesoInstitute will notify the Purchaser of the correct price and if the Purchaser does not wish to purchase the mesoInstitute products at that price, the order will be cancelled.

The delivery charges are as quoted on the Website from time to time. To check relevant delivery charges, please refer to the Delivery Charges page.

3.2 Price and import tax

Prices shown on our website do not include international taxes or other taxes or customs fees that the package management may be incurred upon arrival in the destination country. The vast majority of shipments are delivered free of customs duties and taxes or administration fees; However, the customs agency of the country of destination can select your order for inspection and could collect taxes and duties on your order. These taxes vary from country to country and are not covered by mesoInstitute.

4. PAYMENT CONDITIONS

4.1 Payment for mesoInstitute products can be made:

– PayPal

– Debit card or credit card meso.Institute accepts the following cards: Visa, MasterCard.

– Bank transfer to the ES89 0182 6542 6002 0150 8469 BBVA, indicating in the subject the buyer’s name and order reference account.

Payment by cheque is not accepted.

It is recalled that in accordance with Article 37 of Ley 16/2009 de 13 November de Servicios de Pago, the commitment of payment made through a credit card is irrevocable. To provide information on your credit card, the Buyer authorizes the charge on your card.

4.2 Payment for the Products and all applicable delivery charges is in advance.

The entire transaction shall be effected in encrypted mode and the banking data of the Purchaser shall not transit via the Website.

4.3 Any payment transactions carried out by mesoInstitute or its chosen third-party provider of payment processing services will be encrypted. Although meso.Institute will do its best to protect personal data, the transmission of data is at the Purchaser’s own risk.

4.4 Secure paymentIn meso.Institute, we have the keys (Keys) latest security. Secure Sockets Layer (SSL) certifies that communication with our site is secure and that your data is under encryption keys. In addition, all orders are stored separately using the PGP encryption keys and are individually treated to increase protection against fraudulent activity.

5. DELIVERY

5.1 Delivery procedures

When ordering, the Purchaser should choose the most convenient delivery method from amongst those proposed and, if required, should provide clear delivery instructions if the delivery address is difficult to locate or access.

5.2 Delivery

The delivery of products will depend on the selected by the Purchaser upon ordering option.In any case, unless force majeure or inventory shortages or transport strike and / or postal service, the products must be delivered to the Purchaser within 30 days from the order confirmation.If the merchandise is returned to mesoInstitute because the Purchaser fails to take possession of the parcel containing the products, the Purchaser the order amount will be refunded after deduction of shipping.

5.3 Verification of the order on receipt

The Purchaser should check immediately the condition of the package upon delivery. If the Purchaser has any concerns regarding the condition of the package or if any products are missing from the order or are incorrect or faulty, the Purchaser should inform immediately the delivery driver and notify the concerns on the delivery slip or, if this is not possible, should notify meso.Institute’s Customer Service Team as soon as possible.

The mesoInstitute products will be the Purchaser’s responsibility from the completion of delivery. The Purchaser will own the mesoInstitute products once they have been delivered provided that meso.Institute has received payment in full, including all applicable delivery charges.

6. RIGHT OF CANCELLATION

6.1 Right of cancellation

The Purchaser has the right to cancel their order and withdraw from the contract without reason within the period of fourteen (14) days of the date of receipt of the order. If that fourteen (14) day period expires on a Saturday, a Sunday or a public holiday, the deadline will be extended until the following business day.

In order to exercise this right, the Purchaser shall, before the expiry of the day deadline, inform meso.Institute of his/her desire to cancel the contract. This can be done in the following ways:

– completing the cancellation form available on the Website under the Your Account heading;

– sending a letter or e-mail addressed to mesoInstitute’s Customer Service Team and including the following information: name, postal address, the Purchaser’s telephone number, order number and e-mail address.

6.2 Return of Products

Where the Purchaser exercises their right to cancel, they must return the cancelled products to mesoInstitute within seven (7) days of the date of cancellation.

All the products should be returned complete but not partial and in good condition, in the original packaging. All returns should be sent to the following address: mesoInstitute Polígon Buvisa 08329 Teià, Spain, accompanied by the return form (available under the Your Account heading on the Website).

For reasons of hygiene, cosmetic products must be returned intact, in good condition, in their complete and original packaging and in condition which is suitable resale. Opening these products will make them unsuitable for future resale.

If any free or multi-purchase discount products were included in the cancelled order, these must also be returned with the cancelled products.

The products should be returned in good condition and the Purchaser has a duty to take reasonable care of the goods. Consequently, they may not be repaid, the mesoInstitute accepted or exchanged products that are open, damaged or whose original packaging is damaged .

6.3 Reimbursement following cancellation

mesoInstitute will refund to the Purchaser the amount paid for the cancelled products within 14 days of cancellation. Refunds will only be made against the original payment method.

The costs of returning the product are the responsibility of the Purchaser: the packages sent postage due or COD will not be accepted.The products not accepted will be returned to the Purchaser freight collect.

7. WARRANTY MANDATORY COMPLIANCE AND HIDDEN DEFECTS
